Diligence dans l'établissement d'une cotisation - paragraphe 152(1) L.I.R.
En vertu du paragraphe 152(1) L.I.R., l'ARC doit avec diligence, examiner la déclaration de revenu d'un contribuable pour une année d'imposition, fixer l'impôt payable pour l'année. La jurisprudence a établi que cette notion de diligence est une norme souple qui peut varier sur la base du cas par cas. Malgré la souplesse de cette norme, il nous semble raisonnable de suggérer qu'il existe également une norme fixe, c'est-à-dire qu'il existe un délai à l'intérieur duquel il est raisonnable de s'attendre à ce que l'ARC établisse la cotisation d'une déclaration, nonobstant son niveau de complexité.
L'ARC peut-elle commenter sur les propos ci-dessus ?
Réponse de l'ARC
Il est clair selon le paragraphe 152(1) L.I.R. et la jurisprudence que l'ARC n'est pas assujettie à un délai spécifique pour l'établissement d'une cotisation initiale portant sur l'impôt payable. Le paragraphe 152(1) L.I.R. accorde à l'ARC une certaine liberté essentielle à une saine administration de la L.I.R.
Nous sommes d'avis qu'il ne serait pas possible, ni productif, d'établir une norme fixe qui serait applicable à tous les contribuables et dans toutes les circonstances possibles.

Assessment With All Due Dispatch - Subsection 152(1) of the ITA
Under subsection 152(1) of the ITA, the CRA shall, with all due dispatch, examine a taxpayer's return of income for a taxation year, assess the tax for the year. The jurisprudence has established that this concept of due dispatch is a flexible norm which can vary on a case-by-case basis. Despite the flexibility of this norm, it seems reasonable to suggest that there is also a fixed norm, that is, there is a period of time in which it is reasonable to expect that the CRA will issue an assessment of a return, notwithstanding its level of complexity.
Can the CRA comment on the above remarks?
The CRA's Response
It is clear according to subsection 152(1) of the ITA and the jurisprudence that the CRA is not subject to a specific period of time for the issuance of an initial assessment relating to the tax payable. Subsection 152(1) of the ITA confers on the CRA a certain freedom which is essential for a sound administration of the ITA.
We are of the view that it would not be possible, nor productive, to establish a fixed norm which would be applicable to all the taxpayers and in all possible circumstances.
