Re: XXXXXXXXXX:
We are writing in response to your letter of XXXXXXXXXX wherein you requested certain amendments to advance income tax ruling 962037 dated XXXXXXXXXX, 1996 (the "Ruling") concerning the above mentioned taxpayers.
As a result the following changes are made to the Ruling:
1.Definition (g) on page 3 is amended to add "Debt immediately before "Put\Call".
2.Lines 3 and 4 in paragraph 24 are amended to reposition the phrase "by endorsing the cheque referred to in paragraph 22 above" to come immediately after the term "Particular Lender".
We hereby confirm that the rulings given in the Ruling will continue to be binding on the Department provided that the proposed transactions are completed by XXXXXXXXXX.
