Dear Sirs:
This is in response to your letters of April 14, 1997 and September 5, 1996 and is further to our letter of October 30, 1995 to XXXXXXXXXX and to our various telephone conversations in which you requested us to reconsider whether contributions to the “Civil Service Retirement System” (“CSRS”) in the United States qualify as “non-business-income taxes” for the purposes of the foreign tax credit provisions in section 126 of the Income Tax Act (the “Act”).
As we have discussed in several of our telephone conversations, the views we expressed in our letter of October 30, 1995 letter remain unchanged; such CSRS contributions do not qualify as “non-business-income taxes” for the purposes of claiming a foreign tax credit under section 126 of the Act.
